25-year-old Pratima (name changed) from Ahmedabad is expecting a baby in next two months.

The Union Cabinet on Wednesday gave its nod for the introduction in parliament of the Surrogacy Regulation Bill, 2016, that seeks to "prohibit commercial surrogacy" and allow "ethical surrogacy" to needy infertile couples.

There is new hope for couples dreaming to become parents via surrogacy. The Centre has amended Surrogacy (Regulation) Rules, 2022 to allow use of a donor gamete – ova or egg cells and sperm – if one of the partners is certified to have a medical condition that prevents use of his or her own gametes.

The Bill is aimed at banning commercial surrogacy to protect women from exploitation and ensure the rights of the child born through surrogacy. Once approved by Parliament, there will be a complete ban on commercial surrogacy, but altruistic surrogacy will be permitted for needy infertile couples under strict regulations.

India now joins a lot of countries on the global map who have banned surrogacy.

The Centre has amended the Surrogacy (Regulation) Rules, 2022 to allow the use of donor gametes in surrogacy procedures. This includes single women using self-eggs and donor sperm. The recent amendment was made in response to petitions seeking relief from the ban on donor gametes.

Amid protests by the opposition over the Rafale deal on Wednesday, the Lok Sabha passed the Surrogacy (Regulation) Bill 2016, aimed at banning commercial surrogacy to protect women from exploitation. The House also proposed to allow only altruistic surrogacy by infertile Indian couples from a "close relative" only.

The ministry argued that using donor gametes could lead to a lack of care or rejection of the child. The affidavit was filed in response to a petition challenging a ban on donor gametes for surrogacy. The ministry emphasized the importance of the child's best interest and stated that the new surrogacy rules only permit the use of self gametes.
