KOLKATA: Calcutta high court on Friday wanted to know from state advocate general Bimal Chatterjee that who else will address complaints of attack on lawmakers within the Assembly premises if the Speaker, who is the custodian of the House, doesn't take any action.
Justice Dipankar Datta made the observation while hearing a writ petition filed by CPM MLA from Pandabeswar Gouranga Chatterjee who complained that the SSKM hospital denied him admission after performing some preliminary tests when he was taken to hospital after being beaten up in the House in front of the Speaker.
Chatterjee submitted that he fell ill at night and was taken to a private nursing home that held, after elaborate tests, that he had suffered an internal injury. Citing his predicament, the CPM MLA urged the court's directive to the government to start proceedings against the offending doctors. He also prayed for directions on the Speaker to start proceedings against those who had allegedly beaten up Chatterjee and his colleague Deblina Hembram in front of the Speaker.
The advocate general submitted that the court doesn't have supervisory jurisdiction over West Bengal Legislative Assembly and the Speaker in the event of an incident inside the House. Chatterjee submitted that the Speaker has the sole power to act upon happenings within the Assembly. Saying so, the advocate general informed the court that he would place before the court what steps the Speaker has taken on the incident during the next hearing on Wednesday.
