MACT rejects 2018 accident claim, orders action against IO
Jaipur: A Motor Accident Claims Tribunal (MACT) in Jaipur has dismissed a compensation claim linked to a 2018 road accident, observing that the “offending vehicle was falsely implicated to secure insurance benefits”. The tribunal also ordered action against the investigating police officer, the vehicle owner and the driver.
In its May 7, 2026, order, MACT No. 1, Jaipur Metropolitan-II, presided over by Judge Shiv Kumar, rejected the petition filed by Lotika Devi and her family seeking compensation for the death of Gautam Vishwas in an alleged accident involving car number RJ-40-CA-2295 on Nov 18, 2018. The order was uploaded Monday.
The tribunal held that the “claimants failed to establish the involvement of the insured vehicle in the accident” and pointed to contradictions in witness statements, delay in lodging an FIR, and discrepancies in documentary evidence. “Multiple accident claims were earlier filed involving the same vehicle, raising suspicion about fabricated insurance claims,” the court observed.

Appearing for the insurance company, counsel Jungal Kishor Agarwal argued that the same vehicle was repeatedly shown in several accident claims and alleged that the present petition was fabricated to obtain compensation fraudulently. The tribunal further observed that the then investigating officer of Pragpura police station wrongly implicated the vehicle and filed a chargesheet despite lack of reliable evidence.

The court directed the additional director general of police (vigilance), Rajasthan, to initiate appropriate action against the investigating officer (IO), driver Pappu Kumar Mali, and vehicle owner Kailash Chand Gujar, and submit a compliance report within two months.
