INDORE: A court of ADJ on Saturday sent land shark Bobby Chhabra to two-day remand of Raoji Bazaar police for recovery of evidence from him in connection with fraud case registered against him.
Chhabra was produced in the court of 11th ADJ Dr Gaurav Garg by Kanadia police as his remand ended. The court also sought progress report from the police after the two days.
Raoji police had demanded six days of remand from the court for seizure and recovery of important documents including bank details.
Opposing the six-day remand , counsel of Chhabra Amit Tripathi argued, “The accused had been in remand for the past 15 days at several police stations in similar cases. By taking remand separately in similar cases police are breaching the limit of 14 days of police remand prescribed under CrPC.”
However, the police officials argued that all the cases registered against Chhabra are different and have different crime gravity. So, according to CrPC rules, police are demanding 14-day of remand separately in each cases.
After hearing arguments of both sides, the court remarked, “Yes, police can take remand of 14-day in accordance to law. But, they should produce progress report on Monday after two days of remand.”
The decision about further extension or rejection of remand will be taken after going through the report, the court said.
Counsel of Chhabra also appealed court for less oily and low salt food preferably made at home for Chhabra in jail due his heart problems. He also requested the court to order police to allow Chhabra to walk in corridors since he has anxiety issues.
The ADJ observed that police should provide the food and relief of walking around to accused keeping in mind security issues as it requires, otherwise the purpose of remand will fail, if he falls ill.
Chhabra was wanted by police in several cases of fraud, forgery and land grabbing. He was arrested by police, on February 14.
