The court examined 43 witnesses, including three eye-witnesses and four conspiring witnesses. Fifteen witnesses did not turn up, despite being issued repeated summons and non-bailable warrants.
Advocate C V Nagesh, who appeared on behalf of the accused, argued since the prosecution failed to prove the crime and the accused were acquitted, there were no grounds for the case against Ramesh Kumar and three others for plotting the crime.
Based on its findings, the CoD filed a chargesheet in the Kolar court against Shiva Reddy and 12 others. A case was filed against Ramesh Kumar, his brother Krishnamurthy and two others charging them with conspiring to commit the crime and this was pending in the JMFC, Srinivasapur court.
When the CoD filed a chargesheet against Ramesh Kumar and three others, he obtained a high court stay against inclusion of his name in the case.
Reacting to the verdict, Ramesh Kumar said: "I am a relieved man. Though it has taken time, truth has prevailed finally. I am not a person who believes in cruel acts and my detractors should understand this and desist from levelling such baseless allegations against me."
