Cong files complaint in Bhopal court with data to prove evidence tampering in Vyapam case
BHOPAL: “Today, we have submitted the original CD data which contains the list of Vyapam recommendations with chief minister mentioned 48 times to the court for a trial,” former Union minister and eminent lawyer Kapil Sibal said on Saturday. Vivek Tankha said that the Congress has prepared a 27000 page “clear prosecution story” to reveal the truth about Vyapam. “We are now prepared to prove with evidence the tampering of evidence in the Vyapam irregularities case,” Tankha said.
Kapil Sibal claimed that Congress took-up the Vyapam irregularities issue through legal proceedings. “STF and SIT were appointed to investigate the case and we were providing all evidence in the case but they wouldn’t take heed of it. We asked for a CBI inquiry and then the CBI started doing the same. The CBI filed an affidavit in the Supreme Court claiming they have nothing against chief minister Shivraj Singh Chouhan. So today, we filed a private complaint with original data as evidence,” the former Union minister said.
Recalling the sequence of the case, Kapil Sibal alleged, “There was a time when the STF, SIT and CBI – all three investigating agencies decided to anyhow protect the chief minister and some other ministers. After 2013, every step was taken with the intention of saving chief minister Shivraj Singh Chouhan. There are 3000 accused in the case but the root of Vyapam corruption is the chief minister and we will prove this,” Kapil Sibal said.
Sibal recalled that the entire case revolves around a computer disc which had a list showing names of those recommending for recruitment or admission of candidates through Vyapam. “CM appears 48 times as recommender along with Union minister Uma Bharti and then there is mention of Minister 1, Minister 2 and Minister 3. On July 17, 2013, the STF seized the disc from Indore but did not show the seizure in records. At 4:30 pm the next day, investigating agency shows seizure of the disc from Bhopal,” he claimed.

Sibal claimed that police removed the name of the CM and some others from the list, but Uma Bharti’s name was not deleted. “Under the IT Act, evidence has to come with its hashtag value note during the seizure. They made the changes and then put the hashtag value but the original list (which was in Prashant Pandey’s computer) remains with us. To prove the genuineness of the data, we got the same tested in Truth Laboratories,” he recollected.
The CBI later sent the disc for testing to CFSL Science Laboratories. But even before the laboratory’s report on whether tampering was done reached CBI, the investigating agency gave a clean chit to chief minister Chouhan.

in Indore. “Police did not know how to download the disc and went to Prashant Pandey for help. For downloading of the disc, you need a cable which Prashant Pandey had.
