NCERT apologises for controversial judiciary chapter, withdraws Class 8 textbook

The National Council of Educational Research and Training (NCERT) has issued an unconditional apology over Chapter IV of its recently released social science textbook, Exploring Society: India and Beyond, Grade 8 (Part II). The chapter, titled The Role of Judiciary in Our Society, faced criticism for its treatment of judicial corruption and case backlogs.

NCERT confirmed that the entire book has been withdrawn and is no longer available for distribution. In a statement, the council said: "The director and members of NCERT hereby tender an unconditional and unqualified apology for the said Chapter IV."



Swift action following court intervention

The apology comes a day ahead of a scheduled hearing on March 11 in a suo motu case concerning the textbook. On February 26, the court ordered the immediate seizure of all physical copies and the removal of digital versions that included references to "corruption in the judiciary."




The court had first taken suo motu cognisance on February 25, following the release of Part II of the textbook on February 23. Only 32 copies were sold before it was withdrawn on February 24. NCERT stated that the chapter would be rewritten in consultation with appropriate authorities to ensure accuracy and sensitivity.

Concerns over content and educational impact

The notice to the director of NCERT and the secretary of the school education department mentioned the emphasis laid in the textbook on complaints against judges and judicial inaction. It also highlighted how the textbook did not adequately focus on the judiciary’s contribution to upholding constitutional morality, the basic structure doctrine, legal aid, and access to justice.

The publication could be interpreted as a "calculated move to undermine the institutional authority and demean the dignity of the judiciary." While clearing its position that it is not against the right to criticize, it is against the right to criticize in a biased manner, which could have serious consequences.



Nationwide withdrawal and ban on distribution

NCERT, in coordination with the Union and state education departments, has ensured the withdrawal of all copies of the textbook in physical and digital formats from circulation. The production and distribution of the textbook are now banned, and the court has warned of consequences of contempt of court in case of violation.

In its communication, NCERT has expressed its regret for the inconvenience caused and has thanked all stakeholders for their understanding. "NCERT remains committed to maintaining the highest standards of accuracy, sensitivity, and responsibility in educational content," the statement concluded.
