Pariyathukavu eviction: Kerala HC to hear fresh plea on June 4
Kochi: The superintendent of police (SP), Ernakulam rural, has filed an early hearing plea before high court regarding the case related to the eviction of seven Dalit families from a disputed piece of land at Pariyathukavu in Malayidamthuruth of Kizhakkambalam village in Ernakulam.
A bench of Justice T R Ravi will consider the petition on Thursday. Earlier, the bench had granted the state govt an additional two weeks to evict the families from the disputed land and adjourned the matter for consideration on June 9. This followed a submission by the advocate general that the state govt had been making earnest efforts to resolve the issue amicably.
However, while considering the execution petition on June 1, the Perumbavoor munsiff court directed the SP to provide adequate police assistance to the amin, the advocate commissioner, and other court officials to execute the decree by evicting the families currently residing on the disputed land. The munsiff court further directed the advocate commissioner and amin to file their reports on June 9. Accordingly, the SP has approached HC through an interim application seeking consideration of the matter before June 9.
The dispute originated from a suit filed before the munsiff court in 1984 concerning the ownership of 2.62 acres at Pariyathukavu. The court decreed the suit in favour of the late Sankaran Nair of Kizhakkambalam. Although the defendants — the Dalit families — pursued a series of legal challenges, the higher courts, including the apex court, upheld the decree and judgment. Consequently, an execution order was issued directing the eviction before May 25.
