Man gets 20-yr jail for physical exploitation of 9-yr-old boy

Kanpur: Special judge Pocso Act /additional sessions judge court no XIII Kanpur Nagar Rashmi Singh on Friday convicted one Mohd Jabir under Pocso Act and punished him with 20 years of rigorous imprisonment along with a fine of Rs 25,000 for physical exploitation of a 9-year-old boy.
The presiding judge, in her order, also observed that if the accused failed to pay fine then he had to serve 20 days simple imprisonment term. Around 80% of the fine amount i.e Rs 20,000 be given to the victim as compensation. The period accused had passed in the jail during the trial would be accommodated in the sentence, she further observed.
Special prosecutor, Bhawana Gupta, stated that the complaint was filed on Aug 6, 2020 at Naubasta police station while crime was committed on July 30, 2020. The complainant had alleged that Mohd Jabir, a resident of Macharia locality had tried to physically exploit his nine-year-old son on July 30, 2020. He had lodged an FIR after tracing Mohd Jabir.
The boy, while recording his testimony before the court, stated that the accused had called him on the pretext of giving him biscuits, toffees and kites, which he often used to offer him. According to the testimony, the accused allegedly took the boy to an underground room where he attempted to physically exploit him. The boy stated that he cried and raised an alarm. Jabir threatened to kill him if he disclosed the incident to anyone, said the boy.
