Cops in HC against bail to school caretaker

New Delhi: Delhi Police has moved the high court challenging the bail granted to the 57-year-old school caretaker accused of sexually assaulting a three-year-old girl inside a private school in west Delhi. The accused was arrested on May 1 after the child identified him during the investigation.

He was granted bail by a Dwarka sessions court after it observed that the CCTV footage placed him away from the alleged crime scene at the relevant time and the child’s medical examination did not reveal any injuries.

The alleged incident took place on April 30 and came to light on May 1 after the child fell ill and informed her mother. Based on the complaint, an FIR was registered under Section 64 of BNS and provisions of the POCSO Act.

Opposing the bail plea, prosecutors argued that the allegations were grave and involved a minor child.

However, while granting bail on May 7, the court referred to the medico-legal certificate, which stated that no injury marks or redness were found on the child’s body. The court also noted CCTV footage showing the accused allegedly leaving the junior wing of the school at 8.37am and not returning thereafter.

The court directed the accused to stay away from the school premises till completion of the trial.
