BENGALURU: Coming to the rescue of a 20- year-old BSc student, the Dharwad bench of the Karnataka high court has said that the order of externment of the petitioner from Jamakhandi taluk to Sedam taluk should not be acted upon for two weeks, so as to enable him to attend the examinations which is to he held till April 8.
The order was issued by assistant commissioner of Jamakhandi taluk on the ground there is reasonable apprehension that petitioner Siddu would engage in commission of offences.
Siddu, who hails from Biligi taluk in Bagakakote district, had claimed that the order issued by assistant commissioner externing him from Jamakhandi taluk to Sedam taluk is arbitrary and added that there are no materials warranting the same.
On the other hand, the government advocate submitted that the petitioner has alternative remedy available.
However, intervening in the matter, Justice Sachin Shankar Magadum pointed out with the commencement of examination, petitioner cannot be relegated to alternative remedy and added that he needs some protection.
"The petitioner shall give an undertaking before the assistant commissioner (Jamakhandi) that he will not indulge in any activities which would attract section 55 of the Karnataka Police Act, 1963" the judge further observed in his order while disposing of the petition filed by one Siddu.
The judge has also said that the petitioner is at liberty to challenge the order passed by the Assistant Commissioner before the competent authority.
